By accessing or using the CaseMgmt platform at casemgmt.io (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms. If you do not agree to these Terms, do not use the Service.
CaseMgmt provides a cloud-based nurse case management platform that includes patient case tracking, referral intake, billing and invoicing, AI-powered call transcription, team management, and reporting tools. The Service is designed for healthcare case management companies and is intended to be HIPAA-compliant when used in accordance with our documentation and Business Associate Agreement.
The Service is offered on a subscription basis with various plans. Current pricing is available on our pricing page. We reserve the right to change pricing with 30 days' notice.
We may offer a free trial period. At the end of the trial, your subscription will automatically convert to a paid plan unless you cancel before the trial ends. No charges will be made during the trial period.
Subscription fees are billed in advance on a monthly or annual basis. All payments are processed through Stripe. You authorize us to charge your payment method for recurring subscription fees.
You may cancel your subscription at any time from your account settings. Upon cancellation, you will retain access until the end of your current billing period. No refunds will be issued for partial billing periods.

You retain all ownership rights to the data you upload to the Service (“Customer Data”). We do not claim ownership of your data. You grant us a limited license to process your data solely to provide the Service.
You may export your data at any time through the platform's built-in export features. Upon account termination, we will make your data available for export for 30 days before deletion.
If you use the Service to store or process Protected Health Information (PHI), you must enter into a Business Associate Agreement (BAA) with us. You are responsible for ensuring your use of the Service complies with HIPAA and all applicable healthcare regulations.
The Service, including its software, design, logos, and documentation, is owned by CaseMgmt and protected by intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service during your subscription term.
We strive to maintain 99.9% uptime but do not guarantee uninterrupted access. We may perform scheduled maintenance with advance notice. We provide customer support via email during business hours. Response times may vary based on your subscription plan.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CASEMGMT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. CASEMGMT DOES NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR UNINTERRUPTED.
You agree to indemnify and hold harmless CaseMgmt, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any applicable law or regulation.
We may suspend or terminate your account if you violate these Terms or if your subscription payment fails after reasonable notice. You may terminate your account at any time by canceling your subscription. Upon termination, your right to use the Service ceases immediately, though we will provide a data export period as described above.
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in Harris County, Texas.
We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a notice on the platform at least 30 days before taking effect. Your continued use of the Service after changes constitutes acceptance of the updated Terms.
